These Terms of Use ("Terms") govern your use of the HappyWife mobile application and related services (the "Service"), operated by ACANA LLC, doing business as HappyWife ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service Does

HappyWife helps couples communicate. One partner records or types a message; the Service transcribes it and uses artificial intelligence to generate a personalized summary for the other partner, including optional audio versions, conversation summaries, and response suggestions.

2. Eligibility and Accounts

- You must be at least 18 years old to use the Service.

- You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for activity under your account.

- The Service links two accounts into a "couple" via an invite code. Only invite someone you know and trust. Messages you send through the Service are shared with your linked partner.

3. Subscriptions and Payment

- Plan. HappyWife offers one subscription: $19.99 per month, which covers both partners in a couple. Prices may vary by region and are shown in the App Store before purchase.

- Free trial. New couples receive a 7-day free trial that begins when the second partner joins the couple. If you do not subscribe before the trial ends, sending new messages is disabled until you subscribe; you can still read existing content.

- Billing. Payment is charged to your Apple ID through the App Store. The subscription renews automatically each month unless cancelled at least 24 hours before the end of the current period. Manage or cancel in your device's Settings > Apple ID > Subscriptions.

- Top-ups. We may offer optional one-time purchases (for example, a $4.99 "Message Boost") that add message allowance for the current month. Top-ups are consumable, apply only to the calendar month in which they are purchased, and do not roll over.

- Refunds. Purchases are processed by Apple and refunds are governed by Apple's policies. Request refunds at reportaproblem.apple.com.

4. Fair Use and Monthly Allowance

Generating transcriptions, summaries, and audio costs us real money each time. Each couple's subscription includes a generous monthly usage allowance that resets on the first of each calendar month. We will notify you within the app as you approach the allowance. If you reach it, sending new messages is paused until the monthly reset or an optional top-up; reading existing content is never restricted. We may adjust the allowance over time and will reflect any changes in the app.

5. Your Content

- You retain ownership of the content you create (voice recordings, messages, and text).

- You grant us a limited license to store, process, transcribe, summarize, and transmit your content solely to operate the Service - including sending your content to third-party AI providers for transcription, summarization, and audio generation (see our Privacy Policy).

- You are responsible for your content. Do not use the Service to send content that is unlawful, harassing, abusive, or that infringes anyone's rights.

6. AI-Generated Content Disclaimer

Summaries, transcripts, response hints, and other AI-generated content may contain errors, omissions, or misinterpretations. They are provided for convenience and are not a substitute for reading or listening to the original message, nor for professional advice of any kind. HappyWife is not a therapy, counseling, medical, or crisis service. If you are experiencing a crisis, contact a qualified professional or emergency services.

7. Acceptable Use

You agree not to:

- use the Service for any unlawful purpose;

- attempt to access another user's account or data;

- reverse engineer, probe, or disrupt the Service;

- resell or commercially exploit the Service without our written consent;

- use the Service to harass, threaten, or harm anyone, including your partner.

8. Termination

You may stop using the Service and delete your account at any time from within the app or by contacting us. We may suspend or terminate accounts that violate these Terms. Upon termination, your right to use the Service ends; certain provisions (including Sections 5-6 and 9-11) survive.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate.

10. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim arose.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Hillsborough County, Florida, and you consent to their jurisdiction.

12. Apple App Store Terms

Your use of the app is also subject to Apple's standard Licensed Application End User License Agreement (EULA). Apple is not responsible for the Service or its content and has no obligation to provide support or maintenance.

3. Changes to These Terms

We may update these Terms from time to time. We will post the updated version at thehappywife.ai/terms with a new "Last updated" date, and for material changes we will notify you in the app. Continued use after changes take effect constitutes acceptance.
